Navigating Child Support in Texas

Going through a separation or divorce is emotionally taxing, and figuring out the financial future of your children can feel overwhelming. In Texas, child support is designed with a single goal: ensuring that children receive the financial backing they need to thrive, regardless of their parents' relationship status. Latest Texas child support updates show that clarity and predictability are essential for your peace of mind and your family's stability.

The Texas Percentage of Income Model

Unlike many states that combine both parents' incomes, Texas relies on a "Percentage of Income" model. Unlike Nevada, Texas uses a strict flat percentage based on the number of children needing support. It is a similar percentage model to Wisconsin, focusing almost exclusively at the net resources of the non-custodial parent (the obligor):

  • 20%
    for 1 child
  • 25%
    for 2 children
  • 30%
    for 3 children
  • 35%
    for 4 children
  • 40%
    for 5 or more children

You can compare Texas with Arkansas percentages, or see how Mississippi also applies percentage-based calculations for non-custodial parents.

Understanding the $11,700 Income Cap

To prevent unreasonably high child support orders for high-net-worth individuals, Texas implements a cap on the net resources subject to the standard percentage guidelines. Currently, this cap is set at $11,700 per month in net resources. If the paying parent brings home $20,000 a month net, the standard 20% for one child is only applied to the first $11,700. Use our Texas calculator tool to see how this cap affects your specific income level.

What Counts as "Net Resources"?

Before applying the percentages, the court determines the obligor's "net resources." This is not just base salary. The definition of resources is very broad. It includes commissions, overtime, tips, bonuses, dividend income, and rental income. From that gross total, the court deducts social security taxes, federal income taxes (calculated as if the person is single), union dues, and the cost of the child's health and dental insurance.
